Introduction: the online offer and sale of products on the website WWW.ROSSMARY.IT com are governed by the following general conditions of sale. The sale of hemp, CBD, light cannabis and derivatives to minors under 18 is prohibited. Among the products on sale there are inflorescences and derivatives of Cannabis Sativa L.: permitted uses pursuant to law 242/16; THC content lower than legal limits. All products sold under the Cannabis Light category are intended for technical use, not intended for human consumption, unless otherwise indicated and do not have doping efficacy. Purchase methods
1)To purchase the Products, the Customer must insert the selected Product(s) into the appropriate “Cart” and, after having viewed and accepted the contribution for delivery costs, can proceed with the purchase after having entered the data required for shipping and billing.
2) Once this operation has been completed, the Customer will see a screen containing the summary of the purchase order, including delivery costs, with a request for further confirmation of the purchase procedure.
3) After viewing the summary, the Customer must select the desired type of payment and “click” the button to proceed.
4) With confirmation of the purchase order by the Customer, the conditions of sale and the further information contained on the site will be considered fully known and accepted by the Customer, who also declares to be of age.
5) The Order Confirmation by ROSSMARY srl sent to the Customer at the email address indicated will constitute acceptance of the contractual proposal.
6) The contract will be considered concluded and will be binding for both parties when the Order Confirmation is sent to the Customer.
7) After the payment you will receive an e-mail that will notify you of the receipt of payment and from that moment on will start the time for the preparation and shipment of your order; if you have selected the method of payment by bank transfer, the order will be prepared after receipt on our bank account. You can cancel the contract only after receiving and paying for the goods, as described in “right of withdrawal”.
8) If our staff finds errors in your order or deems your order not to be processed within the required time and manner, you will be notified promptly, indicating your order as REFUSED; should you receive such a message please contact us info@rossmary.it
9) Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damage to people and/or things, caused by non-acceptance, even partial, of an order or by cancellation due to failure to pay within the established deadline.
10) In the product shop published on the rossmary.it website, the availability of the products, even being constantly updated, may undergo variations not in real time and without notice.
11) You are purchasing products that can be viewed and described on our site and you accept that the images of the products may not be perfectly representative of their characteristics, but may differ in color and shades, dimensions or accessory products present in the picture. The images are therefore to be understood as a mere generic representation of the products.
Shipments
1)The delivery times after the shipment and any delays do not depend on ROSSMARY srl, which however undertakes to mediate and try to resolve with the courier any problem related to the delivery. The Customer, with the acceptance of our terms of use, exempts ROSSMARY srl from any liability in this regard. For shipping will be used the address provided during the purchase procedure or when registering at the site, then carefully fill in the full address field in its entirety, and possibly leave a correct number of a cell phone that will be returned to the carrier who will contact you if he has problems with delivery or to fix a second.
2)The courier sends by mail in waybill number, so the recipient can conveniently check the tracking of their shipment. Eventual and unpleasant extra expenses due to default of the recipient (e.g. non-delivery due to repeated absence of the recipient, incorrect or incomplete delivery address or failure to collect parcels from branches or warehouses), are not included in the tariff and go to increase the cost of shipping and therefore paid separately. Warranty for defective goods
If there are inside the package received, damaged or incomplete goods, it is necessary to send within 48 working hours of receiving the package, an e-mail to our address INFO@ROSSMARY.IT with attached photographic documentation of the damaged goods. The e-mail must also contain the reference of the order number, invoice and shipping. With the opening of the file we will proceed to the withdrawal of the defective product and to the refund of the cost of the goods, or to a new shipment of the damaged goods if available, or to send a discount code to use in a subsequent purchase.
Right of Withdrawal
Pursuant to and for the purposes of art. 64 et seq. of Legislative Decree no. 206/05, the Customer may exercise the right of withdrawal and withdrawal from the contract, without any penalty and without specifying the reason within 14 days.
The withdrawal period shall expire 14 days after the day on which you or a third party, other than the carrier designated by you, acquire physical possession of the last good. To exercise the right of withdrawal, the customer must inform us (Enter: invoice or order number, name/name, address and, if available, telephone number and e-mail address) of your decision to withdraw from this contract by means of an explicit declaration, such as a registered letter sent by post to our headquarters ROSSMARY SRL – via Gabriele D’Annunzio 189 – 18038 Sanremo (IM ), Italy or via Email certified to rossmarysrl@cgn.legalmail.it
To comply with the withdrawal period, it is sufficient for the customer to send the communication concerning the exercise of the right of withdrawal before the expiry of the withdrawal period.
Effects of withdrawal. If the customer terminates this contract, all payments made to us, including delivery costs if any, will be refunded (except for any additional costs arising from your choice of a different type of delivery from the less expensive standard delivery offered by us or storage or cash on delivery costs)without undue delay and in any event no later than 14 days from the day on which we are informed of your decision to terminate this contract. These refunds will be made using the same means of payment you used for the initial transaction, if possible, otherwise other method of refund will be agreed; in any case, you will not incur any cost as a result of such refund. The refund may be suspended until we receive the goods. The exercise of the right of withdrawal will be ineffective if the returned product is not intact, or open, or lacks the original packaging, or for lack of elements of the product, or for damage to the product for causes other than transport.
Please return the goods at your own expense or deliver them to our office (inserting a copy of the registered letter or pec and invoice) at: ROSSMARY SRL – via Gabriele D’Annunzio 189 – 18038 Sanremo (IM ), Italy – opening hours Lun-Fri 9:00-17:00 without undue delay and in any case within 14 days from the day on which you informed us of your withdrawal from this contract. The deadline is met if the customer returns the goods before the expiry of the 14-day period.

Governing Law and Dispute Resolution
The contract between ROSSMARY SRL and the Client is governed by Italian law. In the event of a disruption or dispute between ROSSMARY srl and the Customer, the Judge of the place of residence of the owner of this site will have jurisdiction. For Customers domiciled in countries of the European Union, art. 15-17 Reg. 44/01 EU.
